Occasionally the Plaintiff or\u00a0Defendant<br \/>may need to file emergency motions for matters<br \/>concerning temporary custody, support, use of residence or vehicle.<\/span><\/p><p>The Defendant then would usually hire an attorney and that attorney\u00a0would<br \/>file an answer to the complaint and attend any emergency<br \/>hearings. The judge would rule on any temporary emergency matters<br \/>generally and set a trial and pre-trial date. The attorneys<br \/>would\u00a0generally file various motions to get information from the other<br \/>party commonly called Discovery motions. These motions can be in the\u00a0form of<br \/>&#8220;Motions for Discovery, Interrogatories, Request for\u00a0production of<br \/>documents, Depositions, Request for admissions etc&#8221; .<\/p><p>Generally after all the information is gathered through these motions<br \/>the attorneys may send offers to settle to each other. If the parties\u00a0are<br \/>unable to settle the case at the pre-trial conference the judge will<br \/>set the case for trial and after the trial the judge will issue an<br \/>order\u00a0concerning all issues in the divorce including but not limited to<br \/>child\u00a0custody, child support, child visitation, personal property<br \/>division,\u00a0real property division, alimony, retirement benefits etc.<\/p><p>The judge\u00a0could also require the parties to attend mediation before having<br \/>a\u00a0trial.<\/p><p style=\"mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; line-height: normal;\"><b><span style=\"font-size: 12.0pt; font-family: 'Times New Roman',serif; mso-fareast-font-family: 'Times New Roman'; mso-font-kerning: 0pt; mso-ligatures: none;\">WILL AN UNCONTESTED DIVORCE WORK FOR ME?<\/span><\/b><\/p><p><span style=\"font-size: 12.0pt; font-family: 'Times New Roman',serif; mso-fareast-font-family: 'Times New Roman'; mso-font-kerning: 0pt; mso-ligatures: none;\">When it comes right down to it probably 90% of divorces are settled<br \/>without trial.\u00a0Many Divorce&#8217;s will be contested at first, both parties<br \/>hiring lawyers and fighting it out. However most of the time through this<br \/>process time passes and the issues are worked out or the parties just get tired<br \/>of fighting and high legal fees. I have seen contested divorce&#8217;s take years.<\/span><\/p><p><b>People begin contested divorce cases for many reasons. Please look at what I<br \/>consider to be the main ones.<\/b><\/p><p>1. One party is mad\/hurt and wants to hurt the other spouse.<\/p><p>2.The parties are unable to come to an agreement because they cant agree on<br \/>what is fair.<\/p><p>3.One party is not acting rationally and will not agree on much of anything.<\/p><p>4.One party is hiding assets or will not disclose what the assetts are and<br \/>because of this an agreement can not be made.<\/p><p>I will now try to pick these apart to help you answer the question &#8220;<br \/>Will an uncontested divorce work for me&#8221;?<\/p><p>Try to answer this question concerning dealing with a hurt\/mad spouse. Do you<br \/>think hiring a lawyer will get them to the\u00a0emotional point that they can<br \/>accept the end of the marriage and settle matters. Do you think the other<br \/>spouse is more interested in hurting you by having a contested case than they<br \/>are in saving money by having an uncontested one. Do you think over time they<br \/>will cool off and settle the case and do you want to wait that long. You could<br \/>also try mediation.<\/p><p>Try to answer this question. If dealing with the situation where you cant agree<br \/>on what is fair consider the following. Child\u00a0support in Alabama is pretty<br \/>much a math equation. If the dispute is over the amount of child<br \/>support it can be\u00a0resolved easily once the other spouse learns of the law<br \/>concerning child support. They can learn this from you after I<br \/>have\u00a0educated you on the applicable law or from a lawyer they consult.<\/p><p style=\"mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; line-height: normal;\"><span style=\"font-size: 12.0pt; font-family: 'Times New Roman',serif; mso-fareast-font-family: 'Times New Roman'; mso-font-kerning: 0pt; mso-ligatures: none;\">If the dispute is over the\u00a0 marital home , their are many ways to<br \/>resolve this, in fact too many to discuss here see the home section. If the<br \/>dispute is over\u00a0 Alimony read that section also. If the dispute is over<br \/>a\u00a0 retirement account see that section. It can usually be resolved if both<br \/>parties are rational people. If the dispute is over\u00a0 personal property<br \/>consider making a list with a heading husband, one that says wife and one<br \/>that says property and take turns picking items and adding them to the husband<br \/>and wife side and you will probably be happier with that than<br \/>what\u00a0a\u00a0judge would likely do. A judge will divide it how they see fit<br \/>or order it sold . Neither party may like the way the judge divides it. You<br \/>could also try\u00a0 mediation .<\/span><\/p><p>Try to answer this question. If dealing with the situation where one party is<br \/>not acting rationally and wont agree on anything, the real question to answer<br \/>is why are they doing that ? Can this be resolved? \u00a0Well I really dont<br \/>know, it depends. Will time fix it and can you wait. Would a session with a<br \/>therapist fix it and do you want to go. If you want to start<br \/>an\u00a0uncontested case, have us draw up a divorce agreement and send it to<br \/>your spouse we would be happy to help. You could then see if they respond with<br \/>a rational counter offer and go from their. If it must be changed to a contested<br \/>case later this can be easily done by paying the difference between a contested<br \/>and uncontested case. You could also try\u00a0 mediation .<\/p><p>If dealing with the situation where one party is hiding\/not disclosing asetts<br \/>you can explain to them that if they continue it will cost both of you more<br \/>money because you will find the assetts through the\u00a0 discovery<br \/>process\u00a0 . If this does not work Iwould be glad to take your contested<br \/>case if you wish.<\/p><p>In an uncontested case the attorney can only represent one party. The attorney<br \/>can negotiate a settelement with the other spouse if they do not have an<br \/>attorney, but they cant give the other side legal advice. I won&#8217;t attempt<br \/>to list every possible option, therefore I am listing what I consider to be the<br \/>most common in an effort to help you begin to think about the possibilities.<br \/>The possibilities are\u00a0really almost endless we will be glad to assist you<br \/>in coming to a solution.<\/span><\/p><p>1. The parties jointly or one party individually owns real estate located at<br \/>Address_1, City, State Zip. The Wife\/Husband shall be solely responsible for<br \/>and assume and pay, as the same matures the mortgage indebtedness if any on<br \/>said residence and shall indemnify and hold the other party harmless from said<br \/>mortgage indebtedness. The Wife \/Husband shall convey if the property is held<br \/>jointly her \/his ownership interest of the real estate to the other party by<br \/>appropriate<br \/>deed.<\/p><p>2. The cost of reasonable and necessary major<br \/>repairs such as structural, heating cooling, roofing and the like, shall be<br \/>paid equally (50-50) by the parties.<\/p><p>3. The Wife and Husband together and jointly own real estate located at<br \/>Address_1, City, State Zip. The realty shall be placed on the market and sold,<br \/>with the money divided, with _____% to the Wife and ____% to the Husband.<br \/>Before the sale, the Wife \/Husband shall be responsible for and pay the<br \/>mortgage payment, taxes and insurance due on the realty. The Wife \/Husband<br \/>shall live there before the sale. Time Limit Clause In the event the real estate<br \/>remains unsold after ______ months from the _____ day of ___________ , 2003,<br \/>either party shall have the right to obtain judicial sale upon appropriate<br \/>petition.<\/p><p>4. The Wife and Husband together own real estate located at Address_1, City,<br \/>State Zip. The Wife \/Husband shall convey her\/ his ownership of the real estate<br \/>to the Wife\/ Husband by appropriate deed and for that the Wife\/ Husband shall<br \/>pay to theWife \/Husband the sum of $___ Dollars . The Wife\/ Husband shall<br \/>assume and pay any and all money owed on the real estate.<\/p><p><b>WHAT CAN BE DONE WITH THE VEHICLES?\u00a0<\/b><\/p><p>The possibilities for vehicles are more limited. I would say the most<br \/>common options would be the following. 1. Title will be transfered to one party<br \/>and the party recieving title to the vehicle shall make the payments on the<br \/>vehicle and hold the other harmless from said payments. 2. One party will<br \/>transfer their intrest in the vehicle to the other party free of debt. 3. One<br \/>party will transfer their intrest in the vehicle to the other party and make<br \/>the payments on the vehicle for x period of time or until the note is paid.<\/p><p><b>WHAT CAN BE DONE WITH HOUSEHOLD ITEMS?\u00a0<\/b><\/p><p>If a party is having difficulty they may consider the following helpful.<br \/>Consider making a list with a heading husband, one that says wife and one that<br \/>says property and take turns picking items and adding them to the husband and<br \/>wife side and<br \/>you will probably be happier with that than what a judge would likely do. A<br \/>judge will divide it how they see fit or order it sold . Neither party may like<br \/>the way the judge divides it.<\/p><p><b>WHAT ABOUT RETIREMENT PLANS?\u00a0<\/b><\/p><p>Many options are avaliable concerning retirement plans, here are some of<br \/>them. 1. In a long marriage if one party has a retirement plan and the other<br \/>does not the parties could agree on what the retirement plan is worth. The<br \/>party with the plan\u00a0could pay the other party x amount of money over a<br \/>certain period of time to release any claim to the retirement .<\/p><p style=\"mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; line-height: normal;\"><span style=\"font-size: 12.0pt; font-family: 'Times New Roman',serif; mso-fareast-font-family: 'Times New Roman'; mso-font-kerning: 0pt; mso-ligatures: none;\">2. The parties could agree to have a QUADRO developed to divide the<br \/>retirement. A QUADRO or Qualified Domestic Relations\u00a0Order is a court<br \/>order wherby the retirement is split in two and the pention agency will then<br \/>send a check to each spouse monthly for the duration of the retirement. Each<br \/>pention\/retirement agency usually has specific guidelines concerning<br \/>what\u00a0must be in these orders. This is why we charge an additional fee to<br \/>draft them. As you might imagine there can be tax concerns with QUADROs. Please<br \/>consult your tax advisor for information.<\/span><\/p><p><b>WHAT ABOUT ALIMONY?<\/b><\/p><p>The obligation of spouses to support each other does not necessarily<br \/>terminate when they divorce. If the divorce will leave one spouse with very<br \/>little income and the other with enough to contribute to the low-income<br \/>spouse&#8217;s support, the court\u00a0will often award alimony, at least<br \/>temporarily.<\/p><p>Although historically spousal maintenance was typically awarded to homemaker<br \/>wives, to be paid by breadwinninghusbands, that is no longer always the case.<br \/>Now, either spouse may be awarded alimony if the other has the more<br \/>substantial income and the recipient spouse&#8217;s income is insufficient to support<br \/>him or her at the level to which the spouseswere accustomed during the<br \/>marriage.<\/p><p>Spousal support is often awarded in cases in which one spouse has put his or<br \/>her education or career on hold in order to raise the parties&#8217; children while<br \/>the other climbed the career ladder and achieved a higher income. In such<br \/>cases, the<br \/>alimony will often be temporary, providing income for the period of time that<br \/>will enable the recipient spouse to become self-supporting. This temporary, or<br \/>rehabilitative, spousal support enables the spouse receiving it to further his<br \/>or her\u00a0education, reestablish himself or herself in a former career, or<br \/>complete childrearing responsibilities, after which time he orshe can be<br \/>self-sufficient. If one spouse is unable to get a good-paying job, however, due<br \/>perhaps to health or advanced\u00a0age, the support award may be permanent.<\/p><p>The amount and duration of alimony depends on several factors, including:<\/p><p>The length of the marriage;<br \/>The age of each spouse;<br \/>The health of each spouse;<br \/>The ability of each spouse to be self-supporting, including a consideration of<br \/>responsibilities to the parties&#8217; minor children, if any;<br \/>The income of the primary breadwinner; and<br \/>Standard of living the parties enjoyed during the marriage.<\/p><p><b>WHAT TO DO ABOUT DEBT?<br \/><\/b>Options avaliable for debt are more limited. The parties can agree to each<br \/>pay their own debt and hold the other harmless. For the majority of divorces involving minor children, child support<br \/>is a straightforward application of a formula that is entirely a creature of<br \/>statute. Alabama uses a\u00a0model called &#8220;income shares&#8221; to figure<br \/>child support. The formula turns on the following factors:<br \/>The combined gross income of the mother and the father.<br \/>Each parents gross income as a percentage of the combined gross income.<br \/>Any pre-existing obligation to pay child support or alimony.<br \/>The number of children under 19 generally.<br \/>The amount paid for work-related child care,<br \/>The amount paid for health insurance for the children, and the party<br \/>responsible for paying it.<\/p><p><b>HOW IS CHILD SUPPORT PAID?\u00a0<\/b><\/p><p>Child support is usually paid by the child support payment being<br \/>automatically deducted from the payors paycheck by means of an income<br \/>withoulding order. If the payor is self employed the payor can send the child<br \/>suppport to the court or<br \/>agency designated by the court to distribute child support located in<br \/>Montgomery and the court\/ designated agency will forward it to the spouse due<br \/>to recieve it.<\/p><p><b>WHAT IF MY SPOUSE DOES NOT PAY?\u00a0<\/b><\/p><p>If your spouse does not pay a motion can be filed tohold them in contempt<br \/>for nonpayment. The judge could jail them for<br \/>contempt as a means to motivate them to pay.<\/p><p><b>HOW IS CHILD SUPPORT MODIFIED?<\/b><\/p><p>Either parent can force child support to be recalculated at any time, but<br \/>change will occur only if the recalculation results in a change in the<br \/>calculated child support of 10% or more. The way to force the recalculation is<br \/>to file a Petition to Modify,\u00a0which requires payment of the filing fee<br \/>applicable in the county where the petition is filed.<\/p><p><b>WHO WILL GET CUSTODY OF THE CHILDREN? <\/b><\/p><p>A court gives the &#8220;best interests of the child&#8221; the highest priority<br \/>when deciding custody issues. What the best interests of a child are in a given<br \/>situation depends upon many factors, including:<\/p><p>The child&#8217;s age, gender, mental and physical health\u00a0the mental and<br \/>physical health of the parents\u00a0the lifestyle and other social factors of<br \/>the parents, including whether the child is exposed to second-hand smoke<br \/>and\u00a0whether there is any history of child abuse. The love and emotional<br \/>ties between the parent and the child, as well as the parent&#8217;s ability to give<br \/>the child guidance\u00a0the parent&#8217;s ability to provide the child with food,<br \/>shelter, clothing and medical care\u00a0the child&#8217;s established living pattern<br \/>(school, home, community, religious institution). The quality of the schools<br \/>attended by the children\u00a0the child&#8217;s preference, if the child is above a<br \/>certain age (usually about 12), and\u00a0the ability and willingness of the<br \/>parent to foster healthy communication and contact between the child and the<br \/>other parent.<\/p><p style=\"mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; line-height: normal;\"><span style=\"font-size: 12.0pt; font-family: 'Times New Roman',serif; mso-fareast-font-family: 'Times New Roman'; mso-font-kerning: 0pt; mso-ligatures: none;\"><br \/>Assuming that none of these factors clearly favors one parent over the other,<br \/>most courts tend to focus on which parent is likely to provide the children a<br \/>stable environment. With younger children, this may mean awarding custody to<br \/>the parent\u00a0who has been the child&#8217;s primary caregiver. With older<br \/>children, this may mean giving custody to the parent who is best able to foster<br \/>continuity in education, neighborhood life, religious institutions and peer<br \/>relationships.<\/span><\/p><p><b>HOW IS VISITATION HANDLED?\u00a0 <\/b><\/p><p><b>G <\/b>enerally in most divorce agreements we will have a standard visitation<br \/>schedule in them. We will ask the client to make any changes they would like<br \/>and if the parties agree we will incorporate them into the agreement. The<br \/>parties can ultimately\u00a0do what they wish as long as they agree. The<br \/>visitation schedule is helpful when the parties do not agree by giving them<br \/>something to go by. This will often prevent them from having to go back to<br \/>court to litigate the matter. This applies to\u00a0uncontested cases only. If<br \/>the case is tried the judge will usually have their own visitation schedule<br \/>inserted into their orders.
